12A and 80G Registration: A Simple Guide For NGO Founders
12A and 80G Registration: A Simple Guide for NGO Founders
I want to share something that surprises people who start a nonprofit in India. You can have a nonprofit. Still miss out on many donations because you don't have 12A and 80G registrations. These registrations are really important. Donors ask for them. Companies won't give you money without them. Your grant applications will get rejected. The worst part is that getting these registrations isn't that hard. You just need to know what to do. When to do it.
I have seen many good organizations lose out on a lot of money because they didn't get these registrations on time. So I want to help you with that. Whether you just started your nonprofit or you have been working without these registrations this guide will walk you through the process.
What 12A and 80G Do For Your Organization
12A is about the tax status of your organization. When you have 12A, the money your nonprofit makes isn't taxed. Without 12A the government will tax your nonprofit like any business. That means you will have money to do your work.
80G is about your donors. When you have an 80G certificate your donors can get a tax deduction for the money they give to your organization. This is an incentive for people to donate to your nonprofit.
Getting Your Documents Ready
The biggest reason why applications get delayed or rejected is because the paperwork isn't complete. So before you start the application process make sure you have all the documents.
- You will need your organizations registration certificate.
- You will need your PAN card and financial statements.
- You will need a list of your board members with their names, addresses and PAN numbers.
- You will need to write a report about your organizations activities.
Step One: Filing the Application
To apply for 12A and 80G registrations you need to go to the Income Tax efiling portal.
You can log in using your organizations PAN number. If you don't have an account you can create one.
Then you need to fill out Form 10A which's the application form for both 12A and 80G registrations.
Make sure you fill out the form carefully and upload all the documents.
Step Two: What Happens After Submission
After you submit your application it will be reviewed by the Commissioner of Income Tax.
They may ask you for information or clarification. If they do make sure you respond promptly and completely.
The Commissioner is supposed to make a decision within three months. If they don't respond within that time the registration is deemed granted.
Once your application is approved you will receive an approval order with your registration number.
Step Three: Provisional vs Permanent Registration
If your organization is than three years old you will get a provisional registration. This isn't a problem. Provisional registration is fully functional. Donors can still claim tax deductions and your nonprofits income will still be tax-exempt. The only difference is that you will need to apply for registration once your organization's three years old.
Ongoing Compliance
Getting the registration is half the job. You need to renew it every five years.
You also need to file a tax return and audit report.
You need to file a statement of donations received and issue certificates to your donors.
It is an idea to create a compliance calendar to stay on top of all these requirements.
The Honest Truth About Timelines and Expectations
The application process can take anywhere from two to six months or longer. It depends on how complete your paperwork's how quickly you respond to queries.
The key is to invest time in getting your documentation right. Have someone review your application before you submit it. Once you have submitted it check the portal regularly for updates.
Wrapping Up
The biggest regret many NGO founders have is not applying for 12A and 80G registrations sooner. The process is manageable. You just need to understand the steps and take them one at a time. Don't wait until it is too late. Start the process now. You will be glad you did.
